Terms of Service

Welcome to Donify, a service operated by Fastrise.io LLC ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of Donify's web application and related services ("Services"). By accessing or using Donify, you agree to be bound by these Terms.

This policy applies solely to Donify and not to other services or products operated by Fastrise.io LLC.

Acceptance of Terms

By creating an account, accessing, or using Donify, you agree to be bound by these Terms of Service.

1. Eligibility

You must be at least 13 years old and located within the United States to use Donify. By accessing or using the Services, you confirm you meet these eligibility requirements.

2. Account Registration and Responsibilities

Donify accounts are provisioned by us as part of customer onboarding. Self-service signup is not currently offered.

• You must maintain the confidentiality of your account credentials.
• You agree to provide accurate and complete registration information and update it as necessary.
• You are responsible for all activities conducted under your account.

3. Acceptable Use

You agree not to:

• Engage in any unlawful or fraudulent activity using the Services.
• Violate campaign finance laws or applicable regulations.
• Attempt to reverse-engineer, modify, or exploit any part of the Services.
• Use automated tools to access the Services in ways exceeding allowed limits.
• Upload malware, viruses, or any malicious code.
• Interfere with the normal operation of the Services or other users' experiences.
• Upload or manage data in volumes significantly exceeding typical usage patterns (e.g., excessively large or unreasonable data imports) that disrupt or degrade service performance.

We reserve the right to restrict or terminate access if we detect usage that appears abusive, unreasonable, or negatively impacts system performance.

4. Data and Content

• You retain full ownership of all data and content you upload to Donify.
• By using the Services, you grant Fastrise.io LLC (solely for Donify) a license to store, process, and display your data solely to provide and improve the Services.
• You are solely responsible for ensuring your data is accurate and compliant with applicable laws.

4.1 AI-Powered Features (Eva Assistant)

Third-Party AI Processing

Donify's Eva assistant is powered by third-party artificial intelligence services. When you use Eva, your prompts and relevant donation data context may be transmitted to these AI providers (such as Anthropic) for processing. By using Eva, you consent to this data transmission.

No Guarantee of Accuracy

AI-generated responses are provided for informational purposes only. Eva may produce inaccurate, incomplete, or outdated information. You are responsible for verifying any information provided by Eva before acting on it.

Not Professional Advice

Eva is not a substitute for professional legal, financial, accounting, or campaign compliance advice. Do not rely on Eva for decisions requiring professional expertise.

Usage Limits

Eva usage is subject to rate limits to ensure fair access for all users. We reserve the right to modify these limits at any time.

Modifications and Availability

We may modify, suspend, or discontinue AI features at any time without prior notice. We are not liable for any changes to or unavailability of AI features.

5. Payments, Subscriptions, and Billing

Trials

Donify may offer evaluation periods at our discretion. Terms, length, and pricing for any trial are communicated to you in writing before the trial begins.

Subscriptions and Renewal

Subscriptions are arranged with Donify as part of your onboarding. Once active, monthly fees are charged automatically via Stripe on the billing cycle stated in your subscription agreement. Subscriptions renew automatically each cycle until cancelled.

Billing and Payment

Payments are securely processed through Stripe, Inc. ("Stripe"). By subscribing, you explicitly authorize Donify (Fastrise.io LLC) to charge your payment method via Stripe for the subscription fees stated in your billing agreement, on a recurring basis. Fees are non-refundable unless legally required.

Pricing Changes

We reserve the right to change subscription prices with at least 30 days' prior notice. Continued use after a price change takes effect constitutes acceptance of the new pricing. You may cancel your subscription before any price increase.

Discounts and Promotional Offers

Occasionally, Donify may offer promotional pricing or discounts subject to specific terms. We reserve the right to modify or terminate promotions at any time without notice.

Cancellation

You may cancel your subscription at any time by emailing help@getdonify.com. Post-cancellation, you retain access until the end of the current billing period. No refunds are provided for cancellations.

Data Retention and Deletion

It is your responsibility to export any necessary data before cancellation. After your subscription has expired, Donify may permanently delete your data at its discretion. Donify is not liable for any data loss post subscription expiration.

Failed Payments

Access to paid features may be suspended if your payment fails. Repeated payment failures may lead to account suspension or termination.

Chargebacks and Payment Disputes

Chargebacks or disputes against subscription fees may result in immediate suspension of your account. Repeated disputes may lead to termination of service.

Account Ownership and Transfer

Accounts belong solely to the original subscriber and may not be transferred or sold without our express written consent.

Billing Information Accuracy

You must provide accurate billing and contact information. Donify is not responsible for interruptions or data loss due to incorrect billing information.

Service Availability

Donify strives for reliable service but cannot guarantee uninterrupted access. We are not liable for temporary downtime or service interruptions.

Taxes and Regulatory Fees

Subscription fees exclude applicable taxes and regulatory fees, which are your responsibility based on your jurisdiction.

6. Termination

We may suspend or terminate your access to Donify at our discretion, with or without notice, if you violate these Terms or threaten the security or integrity of the platform.

7. Disclaimers

• Donify is provided "as is" without warranties of any kind, expressed or implied.
• We do not guarantee uninterrupted, secure, or error-free access to Donify.
• We are not responsible for your compliance with campaign finance laws and do not provide legal or accounting advice.
• Additional billing-specific disclaimers and liabilities are outlined in Section 5 (Payments, Subscriptions, and Billing).

8. Limitation of Liability

To the fullest extent permitted by law, Fastrise.io LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Donify.

9. Ownership and Structure

Donify is operated by Fastrise.io LLC, which may operate other independent services. These Terms apply solely to Donify.

10. Changes to These Terms

We may update these Terms periodically. Significant changes will be communicated via email or through the Services. Continued use indicates acceptance of updated Terms.
